Making the decision to have a child…is to decide forever to have your heart go walking around outside your body. - Elizabeth Stone
As a parent, you know you'd do anything to keep your children (and fur babies) safe and protected. After all, your role is to act as a safe place for your child as they navigate the ups and downs of life. But what would happen if you could no longer be that safe place?
These kinds of decisions, the ones with all the what if’s and worst case scenarios, are the last thing we want to deal with. So what do we do instead?
We put them off (see also: bury head in sand).
However decisions such as Guardianship are way too important to avoid. Because while, to you, your Will is just that nagging dot-point on your mental to-do list; when it comes to your loved ones, your Will is their future.
Appointing a Guardian
Guardianship under Wills applies in the unlikely event that your children and/or pets become orphaned. When it comes to choosing a person (or people) to be a Guardian, you simply need to nominate two tiers:
Guardianship when Co-parenting
If you have parenting orders which stipulate what would happen if one parent dies before the other parent, then these orders will generally be followed. If you do not have orders that cover this, the Court will likely consider your wishes relating to guardianship in your Will, along with any other competing claims for guardianship, and will make a determination based on the best interests of your child.
